1. Booking and Reservations
1.1 Booking Process
All bookings are subject to availability and confirmation by Exotic Island Travels. A booking is not confirmed until we have received your deposit payment and sent a written confirmation.
1.2 Deposit and Payment
A non-refundable deposit of 30% is required to secure your booking. The remaining balance is due 30 days before your charter date. We accept all major credit cards, bank transfers, and electronic payment methods.
1.3 Pricing
Prices are subject to change without notice until your booking is confirmed. Confirmed prices are guaranteed. Pricing includes all agreed-upon services unless otherwise specified in your booking confirmation.
1.4 Incorrect Information
You are responsible for providing accurate information during the booking process. We are not liable for errors, omissions, or delays caused by incorrect information provided by you.
2. Cancellation and Refunds
2.1 Cancellation Policy
- 60+ days before departure: Full refund minus deposit
- 30-60 days before departure: 50% refund
- Less than 30 days: No refund (forfeit full payment)
2.2 Force Majeure
In case of cancellation due to severe weather, natural disasters, or other unforeseen circumstances beyond our control, we will offer a full refund or rescheduling to an alternative date.
2.3 Guest-Initiated Cancellation
Cancellations must be submitted in writing via email or contact form. Cancellation requests are effective upon receipt.
3. Guest Responsibilities
3.1 Age and Capacity
All guests must be at least 18 years old to book a charter. Guests under 18 may participate with a parent or legal guardian present. We reserve the right to refuse service to any guest who does not meet safety requirements.
3.2 Health and Safety
By booking with us, you confirm that you are in good health and physically capable of participating in the booked activities. You assume all risks associated with your participation. Inform us of any medical conditions or mobility limitations in advance.
3.3 Conduct
Guests are expected to behave respectfully and follow all crew instructions. We reserve the right to terminate a charter and refuse service to guests who engage in:
- Illegal activities
- Violent or abusive behavior
- Excessive alcohol consumption or drug use
- Disrespect to crew members or other guests
No refunds will be issued for early termination due to guest misconduct.
3.4 Documentation
You are responsible for obtaining all necessary travel documents, including passports and visas. We are not responsible for immigration issues or denied entry.
4. Liability and Assumption of Risk
4.1 Assumption of Risk
By participating in a charter, you acknowledge that water activities involve inherent risks, including but not limited to drowning, injury, and property damage. You assume all risks associated with your participation.
4.2 Limitation of Liability
To the fullest extent permitted by law, Exotic Island Travels is not liable for:
- Personal injury, illness, or death
- Loss, theft, or damage to personal property
- Delays, schedule changes, or cancellations
- Indirect, incidental, or consequential damages
4.3 Waiver of Liability
By booking with us, you waive the right to bring claims against Exotic Island Travels, its partners, and crew members for injuries or damages occurring during the charter, except in cases of gross negligence or willful misconduct.
4.4 Insurance
We recommend obtaining travel and activities insurance. We are not responsible for claims not covered by your insurance.
5. Modifications and Delays
5.1 Schedule Changes
We reserve the right to modify or reschedule your charter due to weather, safety concerns, or other unforeseen circumstances. We will notify you as soon as possible and offer alternative dates or a refund.
5.2 Vessel Changes
While we will use the vessel specified in your confirmation when possible, we reserve the right to substitute with a comparable vessel if the original is unavailable.
5.3 Itinerary Changes
We reserve the right to modify the itinerary based on weather, sea conditions, or other operational factors.
6. Services and Activities
6.1 Charter Services
Our services include vessel rental, captain and crew services, and access to specified activities. The specific services included are detailed in your booking confirmation.
6.2 Third-Party Activities
Some activities may be provided by third-party operators. We are not responsible for their actions, services, or safety practices. You assume all risks associated with third-party activities.
6.3 Equipment and Safety
All equipment is subject to inspection and use at your own risk. Life jackets and safety equipment must be worn as instructed. Failure to follow safety instructions may result in denial of activity participation.
7. Intellectual Property
All content on our website, including text, images, logos, and designs, is the intellectual property of Exotic Island Travels. You may not reproduce, distribute, or transmit any content without written permission.
